Town Council
November 27, 2024
The Regular Session was called to order by Mayor Kenney at 2pm with Councillors Irene Baker, Louann Link, Max Kenney and Laurie Smith present.
ADDITIONS TO THE AGENDA:
APPROVAL OF THE AGENDA:
It was moved by Councillor Link and seconded by Councillor Baker that the agenda as well as the additions be approved as circulated. Motion carried unanimously.
APPROVAL OF THE PREVIOUS MINUTES:
It was moved by Councillor Baker and seconded by Councillor Link that the minutes from the previous meeting be approved as circulated. Motion carried unanimously.

REPORTS:
Streets, Sewers and Unsightly Premises:
The addition of a Street concern (a) was discussed at this time. There is a sharp corner on School St Extension, in which there is no shoulder and a deep ditch, this poses some concern that during winter when it snows it cannot be determined where the ditch exists, and vehicles tend to misjudge the width of the road and slide into the ditch. The street committee will investigate this to determine the course of action for rectification.

Recreation:
Councillors Link and Baker shared what had been done to date for the Town Christmas party and that of the Breakfast with Santa. These two events are being held at the West Head Wesleyan Church. Councillor Kenney motioned to donate two hundred dollars ($200) to the church in appreciation of the use for our holiday events, Councillor Baker seconded the motion, motion carried.

NEW BUSINESS:
This was discussed in length, since the Town no longer has a gas station, Public Works found it difficult to fuel up the backhoe and/or the diesel truck, which are used for winter plowing among other things on a regular basis. They had inquired if it were possible to install a diesel fuel tank on the property at 69 Woodland St, which is the site of the Wastewater Treatment Facility. This would have to be looked into in much more detail before a decision can be made, such as the required permits, if any, and any safety or environmental factors.

In July of 2024 a letter was sent to the Minister of Fisheries, Diane Lebouthillier, regarding the mediation process in treaty fishing rights disputes and the decision concerning the elvers quota allocation, this was sent on behalf of the 5 Shelburne County municipal units and cc’d to the other units of the Ocean’s 11 group. A reply was received on October 31st and was shared with the group. It was the consensus of the group to schedule a meeting to discuss the reply from the Department of Fisheries, with Council consent. The group consists of the Mayors/Wardens and CAO’s/Clerks from Digby to Lockeport. It was motioned by Councillor Baker, seconded by Councillor Link, to attend the meetings, motion carried.
The Mayors/Wardens, CAO’s and Clerks of the five Shelburne County municipal units felt that a healthcare needs assessment should be considered for Shelburne County residents. For the past several years Shelburne County has been actively advocating for improved healthcare services to address growing concerns about access and quality of care. A healthcare needs assessment would allow us to identify specific gaps and ensure that our advocacy efforts are evidence-based and targeted.
Councillor Link motioned to support the healthcare needs assessment for Shelburne County, Councillor Smith seconded the motion, motion carried.
Ms Goodwin approached the Town inquiring of space in which she could operate a small coffee/sandwich shop. In the past, one had been operated from the Heritage Hall. Two places were considered, that of Heritage Hall and the former storage area of the old Visitor Information Centre which in part is occupied by Scotia Fundy Inshore Fisherman’s Asso. Of the two, if was felt that former storage space in the old Visitor Information Centre would be the ideal spot. The Clerk pointed out that, that the area in which they were considering had been approved by Council at an earlier meeting for public washrooms. It was thought that was enough space to do both. Much consideration was given to how the Town could best accommodate Ms Goodwin to get her small business off the ground. After her initial day of operation, it was considered giving her free rent for the first six months.

Councillor Baker motioned to forego rent for the space for the first six months of operation, Councillor Link seconded the motion, motion carried with one opposition, that of Councillor Smith.
An inquiry was made of the Town to determine if any member of Council had been appointed to the board of SASI. At the time of inquiry, there had been no appointments to this board. Councillor asked of the Clerk to find out further information, such as: does their terms of reference require a member of Council to sit on the board, how often do they meet, and where the meetings are usually held.
Councillor Baker motioned to give the four full time employees and that of the cleaner the agreed upon bonus for the holidays, Councillor Link seconded the motion, motion carried.

Regular Session
Town Council
November 05, 2024
The Regular Session was called to order by Clerk, Jennifer Jones at 7pm with Councillors Irene Baker, Louann Link present. The new elects, Mayor Clay Kenney and Councillors Maxie Kenney and Laurie Smith were sworn in, Mayor Kenney by Clerk, Jennifer Jones, in which the meeting was turned over to the mayor, who continued to swear in the others. Councillor Baker was chosen as Deputy Mayor by secret ballot.
Committee members were then selected of which you will find at the office of the Clerk or on the Town’s website.

Recreation:
The Town Christmas Party, 7-9pm and Breakfast with Santa, 9-11am, was discussed with dates of December 6th and 7th, respectively, this event will be held at the community room at the West Head Wesleyan Church. Pre-registration is required.

Councillor Kenney motioned to rent out the Town Hall for the Provincial Election on the 26th of November, this is for the residents of Clark’s Harbour to cast their vote, Councillor Baker seconded the motion, motion carried.
NEW BUSINESS:
Councillor Baker motioned to apply for Canada Day Funding through Heritage Canada, Councillor Link seconded the motion, motion carried.
Councillor Link motion to apply for funding through the Canada Summer Job portal to hire a student or someone under the age of 30 to do ballpark maintenance during the summer months, Councillor Smith seconded the motion, motion carried.

Councillor Link, seconded by Councillor Kenney, motioned that the Clerk apply for funding through GRID program for the planning and management of the construction of a new wastewater treatment facility. Motion carried.
Due to the possible changes of MGA (Municipal Government Act) Part XX and of the FOIPOP (Freedom of Information and Protection of Privacy) Act, it was suggested to Council that they no longer use their personal electronic devices to conduct Town Business, or their privacy could be compromised. Councillor Link, seconded by Councillor Smith, motioned those electronic notebooks be purchased for the five Council members and one for the Clerk, motion carried.
To keep transparency at the forefront, Councillor Link motioned to purchase a recorder to record Council meetings, seconded by Councillor Baker, motion carried.
The town was approached by Ruth Thomas, on behalf of the Clark’s Harbour Elementary School, inquiring if the Town would purchase a sign to be located at the end of School St (attached to the school fence) indicating where the school was located. As Council didn’t have enough information regarding size and what they wanted on the sign, Council thought it best if the school asked by means of email or letter, stipulating exactly what they were looking for.
In the past, there has not been a regular meeting of Council in December. Councillor Baker motioned to forego December’s regular meeting and reconvene on January 7th, 2025, Councillor Kenney seconded the motion, motion carried.
Whereas the Minister of Municipal Affairs and Housing for the Province of Nova Scotia has made the Code of Conduct for Municipal Elected Officials Regulations, N.S. Reg. 220/2024 (“the Regulations”); and,

Whereas municipalities are required to adopt the model code of conduct prescribed by the Regulations on or before December 19, 2024, pursuant to section 4(1) of the Regulations and section 23A of the Municipal Government Act;
Therefore, be it resolved that the Council of the Town of Clark’s Harbour hereby adopts the model code of conduct as set forth in Schedule “A” to the Regulations, which shall be titled the “Code of Conduct for Elected Officials of the Town of Clark’s Harbour.
Motioned by Councillor Baker, seconded by Councillor Link, motion carried unanimously.
Councillor Baker motioned for the Clerk to transfer the 2023/2024 surplus of two hundred seventy-two thousand, one hundred forty five dollars ($272,145) to the Operating Reserve fund, seconded by Councillor Link, motion carried.
h) Adoption of the Accessibility Plan
